In America, most parents assume they have a fundamental right to direct the upbringing and education of their children. Surprisingly, the relevant U.S. Supreme Court’s Constitutional views on parental rights are chaotic and largely relegated to each state’s political whims.
In the most recent major Supreme Court decision on the issue (Troxel v. Granville in 2000), Justice Scalia held that parents have no constitutionally protected rights whatsoever.
